Waiver Statement:

SFRPD Volunteer Agreement and Waiver of Liability 

In consideration for being granted permission to work as a volunteer, I, the undersigned, am over the age of 18 or (if under 18) have permission from my legal guardian to participate in SFRPD volunteer event and shall protect, hold free and harmless, defend and indemnify the City and County of San Francisco including its agents from any and all claims of any kind and from all liability, penalties, costs, losses, damages, expenses, claims, or judgments (including attorney's fees) resulting from injury): death, or damage to visitor, third parties, myself or other volunteers, or property of any kind, which injury, death or damage arises out of or is in any way connected to the volunteer work assignment. Thus, I forever release SFRPD, along with their respective directors, officers, employees, volunteers, agents, contractors, and representatives (collectively “Releasees”) from any and all liabilities, causes of action, lawsuits, claims, demands, or damages of any kind whatsoever that I, my assignees, heirs, distributees, guardians, next of kin, spouse and legal representatives now have, or may have in the future, for injury, death, or property damage, related to (i) my participation in these activities, (ii) the negligence or other acts of any Release, whether directly connected to these activities or not, and however caused, or (iii) the condition of the premises where these activities occur, whether or not I am then participating in the activities, to the fullest extent permitted by law. I also agree that I, my assignees, heirs, distributees guardians, next of kin, spouse and legal representatives will not make a claim against, sue, or attach the property of any Releasee in connection with any of the matters covered by the foregoing release. 

I understand that these activities can be physically demanding and that I am in good health and able to perform these activities. I will not undertake any part of any activity that I cannot physically perform. 

I agree to use all safety equipment provided and have heard the safety procedures before beginning the volunteer work. I agree that per SFRPD, I am not allowed to operate city vehicles nor operate any power-operated tools and I agree to follow directions of SFRPD Staff, SFRPD Gardeners, SFRPD manager and/or their delegated staff member. 

I expressly and knowingly waive all right under the California Civil Code Section 1542, which provides, “A general release does not extend to claims that the creditor or releasing party does not know or suspect to 

exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” 

I further expressly agree that the foregoing Release, Waiver, and Indemnity clauses are intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I recognize that this waiver agreement, including the waiver and release provisions, is intended to be an enforceable legal document. I have had sufficient time and opportunity to carefully read and fully understand the provisions of this entire waiver agreement and having had a sufficient opportunity to consider its terms have chosen to voluntarily enter into this waiver agreement. This waiver agreement is binding on and shall inure to the benefit of Adult, Child, SFRPD, and their respective successors, assigns and legal representatives. All matters arising out of or relating to this waiver agreement shall be governed by and construed in accordance with the internal laws of the State of California. 

I have carefully read this agreement and fully understand its contents. I am aware that this is a release of liability and a contract between myself, SFRPD, and sign it of my own free will. 

Photo Policy 

Occasionally photos may be taken of participants in the programs, classes and activities offered. These photos may be used in future program guides, brochures, websites, pamphlets, flyers or news releases. By completing this volunteer agreement, I am acknowledging and hereby grant permission for us and our program partners to use photos we may take of myself and/or my minor child while participating in our programs, classes and activities in the ways described above. I waive any rights of compensation or ownership thereto. 

COVID-19 Information 

The collective effort and sacrifice of San Francisco residents staying at home limited the spread of COVID-19. But community transmission of COVID-19 within San Francisco continues, including transmission by individuals who are infected and contagious, but have no symptoms. Infected persons 

are contagious 48 hours before developing symptoms (“pre-symptomatic”), and many are contagious without ever developing symptoms (“asymptomatic”). Pre-symptomatic and asymptomatic people are likely unaware that they have COVID-19. The availability of volunteer events is an important step in the resumption of activities. 

However, the decision by the Health Officer to allow volunteer events that follow required safety rules, does not mean that attending volunteer events is free of risk. Attending a volunteer event could increase the risk of becoming infected with COVID-19. Each person must determine for themselves if they are willing to take the risk of attending a volunteer event, including whether they need to take additional precautions to protect the health of themselves, and others in the household. They should particularly consider the risks to household members who are adults 60 years or older or anyone who has an underlying medical condition. Volunteers may want to discuss these risks and their concerns with their health care provider. More information about COVID-19 and those at higher risk for serious illness is available on the Centers for Disease Control and Prevention website at https://www.cdc.gov/coronavirus/2019-ncov/. 

I understand the risks associated with participating in a volunteer event and agree to assume the risks to myself and my household. I also agree to follow all safety requirements that the volunteer event imposes as a condition of attending.
